Is the parking area private property or common area?

Recently we painted the entire basement area of Yamuna block. As you are aware, the parking areas in the basement have been purchased by various corporates or individuals for a fee.

Is the association responsible for maintaining this area in terms of upkeep, cleaning, painting and other general maintenance or not?

I feel it is common area because:

• People have purchased vehicle parking rights for that area and nothing more than that.
• One cannot cordon-off the area and claim ownership rights by building a room, etc.
• Any resident can walk through these areas without it being called as trespassing.

The only right you have is to park your vehicle in that slot. Nothing more, nothing less. Please do let us know your valuable view on this since we are having an argument on this count.
